Abstract
The increasing use of artificial intelligence and automated decision-making systems has transformed how decisions affecting individuals are made in modern societies. Automated Decision-Making (ADM) is now widely used in areas such as criminal justice, credit assessment, recruitment, and welfare administration. While these systems promise efficiency and consistency, they also raise serious legal and constitutional concerns, including algorithmic bias, lack of transparency, accountability gaps, and potential violations of fundamental rights. This article examines the concept of automated decision-making and critically analyses the legal and ethical challenges arising from its deployment. It further evaluates the existing regulatory framework at the international level, particularly the European Union, and compares it with the Indian legal position. Using doctrinal research methodology, the article argues that India lacks a comprehensive legal framework to regulate ADM systems effectively. It concludes by suggesting a balanced regulatory approach that promotes technological innovation while safeguarding constitutional values through transparency, accountability, and meaningful human oversight.

Suggestions and Way Forward
To ensure responsible use of automated decision-making, transparency must be made a legal obligation. Individuals should be informed when decisions affecting them are made using automated systems and should be provided with meaningful explanations. Secondly, human oversight should be ensured through a human-in-the-loop model, particularly for decisions impacting fundamental rights.
Regular algorithmic audits should be mandated to identify and mitigate bias and systemic errors. Establishing an independent regulatory authority to oversee the deployment of ADM systems would further strengthen accountability.
